Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Drew Bedard ("we", "us", or "our") governing your use of Pitcher Plan (the "Service").
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. By continuing to use the Service, you acknowledge that you have read, understood, and agree to these Terms.
2. Description of Service
Pitcher Plan is a web-based application that provides structured, science-backed weekly pitching plans for parents and coaches to help prevent arm injuries in youth pitchers.
3. Account and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated.
4. Acceptable Use
You agree not to misuse the Service, including:
- Using the Service for any unlawful purpose.
- Engaging in fraud, spam, or deceptive practices.
- Infringing on intellectual property rights.
- Interfering with the security or integrity of the Service (including malware, probing, or scraping).
- Reverse engineering or attempting to extract source code.
- Reselling or redistributing access to the Service.
5. Intellectual Property
All content, software, designs, text, graphics, and branding associated with the Service are owned by Drew Bedard and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.
6. Payment and Subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscription fees are billed in advance on a recurring monthly basis. You authorise us (through Paddle) to charge your chosen payment method.
7. Cancellation and Termination
You may cancel your subscription at any time through your account or by contacting Paddle. Upon cancellation, you will retain access through the end of your current billing period. We reserve the right to suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated violations of these Terms.
8. Service Level
We do not guarantee that the Service will be uninterrupted, error-free, or secure. The Service is provided on an "as is" and "as available" basis.
9. Limitation of Liability
To the fullest extent permitted by law, our aggregate liability is capped at the total fees you paid to us in the six months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill, except where prohibited by law.
Pitcher Plan provides general guidance on arm care and throwing programs. It is not medical advice. Always consult a qualified medical professional for diagnosis and treatment of injuries.
10. Governing Law
These Terms are governed by the laws of the jurisdiction in which Drew Bedard operates, without regard to conflict of law principles.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be posted on the Service with an updated effective date. Continued use after changes constitutes acceptance.
